Basical information

People That Have residence Permits Within the EU Do Not Need Visas. A valid residence permit issued by a Schengen Member State and a travel document are enough to go to another Schengen state for a short visit without a visa. Residence permits issued by Ireland, Bulgaria, the United Kingdom, Cyprus and Romania do not give the right to travel to Schengen states without visas, since these countries do not apply the Schengen Acquis.

What is a temporary residence permit in the Republic of Lithuania?

A temporary residence permit in the Republic of Lithuania means a document granting an alien the right for temporary residence in the Republic of Lithuania for a period specified in the permit. The alien has the right to choose his place of residence in the Republic of Lithuania, to change it, to depart from and return to the Republic of Lithuania during the period of validity of the residence permit. A temporary residence permit in the Republic of Lithuania is issued to an alien who is a citizen of a non-EU Member State. It is usually issued for a period of one year, though it may also be issued for a shorter period.

Who may receive a temporary residence permit?

Law on the Legal Status of Aliens, which regulates the legal status of aliens, stipulates the following grounds for the issuance of temporary residence permits to aliens. A temporary residence permit may be issued to an alien if:

  • the alien has retained the right to citizenship of the Republic of Lithuania
  • it is a case of family reunification
  • the alien intends to work in the Republic of Lithuania
  • the alien has registered a company in Lithuania
  • the alien intends to study
  • the alien has been put under guardianship/custody
  • the alien intends to carry out scientific research 

Where must documents for the issuance of a temporary residence permit be submitted?

An alien must submit an application for the issuance of an initial temporary residence permit and other documents to the Lithuanian embassy abroad, and an alien who is lawfully staying in the Republic of Lithuania – to a migration office of a territorial police agency in the territory of which he intends to reside. However, the lodging of such an application does not entitle the alien to stay in the territory of the Republic of Lithuania before the alien’s application has been examined and a decision on the issue has been taken. An application for the replacement of a temporary residence permit (issuance of a new one) is to be lodged by the alien with a migration office of a territorial police agency.

Who takes a decision on the issuance of a temporary residence permit and issues it?

A decision on the issuance (replacement) of a temporary residence permit to an alien is made by the Migration Department under the Ministry of the Interior of the Republic of Lithuania (hereinafter referred to as the “Migration Department”), but not by the Embassy where person submits documents for residency permit. After the Migration Department or a migration office of the place of residence adopts a decision on the issuance (replacement) of a temporary residence permit, an alien must, upon the receipt of a notice of the decision, refer for the execution of the permit to the migration office of the place of residence. A decision on the issuance (replacement) to an alien of a temporary residence permit in the Republic of Lithuania becomes invalid where the alien fails to use it during three months from the adoption of the decision.

How long does it take to consider an alien’s application for the issuance of a temporary residence permit?

An alien’s application for the issuance of the first temporary residence permit is considered approximately in 3-4 month but not later than within six months from the lodging of the application with a relevant institution. An alien’s application for the replacement of a temporary residence permit (i.e., issuance of a new permit) is considered not later than within two months from the lodging of the application. The application must be lodged for this permit at least two months before the expiry of the current temporary residence permit, but not earlier than four months before the expiry of the current permit.
